These Terms of Use ("Terms") form a legal agreement between you and Streal B.V. ("we", "us"), the developer of Sport Coach Assistant (the "Licensed Application"). By downloading, installing or using the Licensed Application, you agree to these Terms. If you obtained the Licensed Application via the Apple App Store, these Terms are additional to Apple's standard end-user license agreement; where they conflict, Apple's terms apply for the Apple-specific parts.
1. Scope of License
We grant you a non-transferable license to use the Licensed Application on any device that you own or control, subject to these Terms and the usage rules of the app store from which you obtained the application. You may not distribute, make available over a network, sell, rent, lease, lend, sublicense, or otherwise commercially exploit the Licensed Application. You may not copy (except as expressly permitted), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application.
2. Consent to Use of Data
You agree that we may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. We may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you. 3. Services and Third-Party Materials
The Licensed Application may enable access to services and websites operated by us or third parties (collectively and individually, "Services"). Use of the Services may require internet access and your acceptance of additional terms. You agree that we are not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of third-party materials or websites.
4. Termination
These Terms are effective until terminated by you or us. Your rights under these Terms will terminate automatically without notice if you fail to comply with any of its provisions. Upon termination you must cease all use of the Licensed Application and destroy all copies of it.
5. No Warranty
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY.
6. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL STREAL B.V. BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION.
7. Export Compliance
You may not use or otherwise export or re-export the Licensed Application except as authorised by the laws of the Netherlands, the European Union, and the jurisdiction in which the Licensed Application was obtained.
8. Commercial Items
The Licensed Application and related documentation are "Commercial Items". If you are a government end-user, you acquire the Licensed Application with only those rights set forth herein.
9. Governing Law
These Terms are governed by the laws of the Netherlands, excluding its conflict of law rules. This limitation does not apply to consumers where mandatory local consumer protection law provides otherwise.
10. Third-Party Beneficiary
You acknowledge that, where the Licensed Application is obtained through the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right to enforce them against you as a third-party beneficiary.
